Information note on the actions being taken by the U.S. in the Rio Grande River in the area of Eagle Pass, Texas

  • The Government of Mexico sent a diplomatic note to the United States to express its concern over the installation of razor concertina wire and barrels and the earthworks and clearing done on an island in the Rio Grande, downstream from the Piedras Negras-Eagle Pass International Railroad Bridge, in addition to the installation of a buoy barrier. In this regard, the following points were communicated:
    • The Government of Mexico expressed its concern about the aforementioned activities, in that the concertina wire and barrels may obstruct and deflect the normal and flood flows of the Rio Grande, which is made worse by the debris trapped in the razor wire fence, especially if it is dragged downstream by a flood.
    • Installation of the buoy barrier by Texas in the Rio Grande, starting in the Eagle Pass area, contravenes Article 17 of the 1944 International Water Treaty, which establishes that "The use of the channels of the international rivers for the discharge of flood or other excess waters shall be free...".
    • It also violates Article IV B (1) of the 1970 Boundary Treaty, which states that "Both in the main channel of the river and on adjacent lands to a distance on either side of the international boundary recommended by the Commission and approved by the two Governments, each contracting State shall prohibit the construction of works in its territory which, in the judgment opinion of the Commission, may cause deflection or obstruction of the normal flow of the river or of its flood flows."
    • On June 26, the Government of Mexico asked the United States to remove both the barrels and the concertina wire fence from the Rio Grande because they obstruct and deflect the flow into Mexican territory, and not to install them in the flood zone or river in the future.
    • The Government of Mexico also requested that any work, including the clearing of islands and the channel of the Rio Grande be endorsed by the International Boundary and Water Commission (IBWC) between Mexico and the United States.
